AI Product Terms of Use

Effective as of 26 February 2024
These terms apply to your use of AI-powered products and tools within Infogram (“AI Products”) and supplement the Infogram Terms of Service (the “ToS”), as applicable (collectively, “the Agreement”). We reserve the right to update these terms from time to time. Capitalized terms not defined herein will have the meaning assigned to them in the Agreement.
Infogram’s Use of AI
Infogram now has AI features integrated within the application. We wish to give you this information and to allow you to see where the AI feature may be selected so that you may make an informed decision about your use.
Use of AI Products
In addition to the provisions on use included in the Terms of Use, you may not use Infogram’s AI Products to create, upload, or share abusive, illegal, misleading, or confidential content. Such content includes, but is not limited to, the following:
- Pornographic material or explicit nudity;
- Medical advice or content related to treatment, prevention, diagnosis, or transmission of diseases;
- Hateful or highly offensive content that attacks or dehumanizes a group based on race, ethnicity, national origin, religion, serious disease or disability, gender, age, or sexual orientation;
- Graphic violence or the promotion, glorification, or threat of violence;
- Illegal activities or goods;
- Promotion of terrorism or violent extremism;
- Misleading, fraudulent, or deceptive content; and
- Personal or private information of others in violation of their privacy or data protection rights.
Infogram also advises you to not include personally identifiable information (PII) as an Input.
You are responsible for the text you input or other content you upload to AI Products (“Input”) as well as the content generated (“Output”) (collectively included in the definition of “User Content” as set forth in the Agreement). You are responsible for ensuring that your User Content complies with these terms and the Agreement before using or sharing it. You agree that you will not include any sensitive personal data (including racial or ethnic origin, political opinions, religious beliefs, trade union membership, health data, or data concerning sexual activity or orientation) in any Input to AI Products.
You may use your Output for any legal purpose, provided that you comply with these terms and the terms of the Agreement and that you accept that any such use is at your own risk.
AI Products Use Disclosure
When posting or publishing User Content created in whole or in part with AI Products, you will
- Manually review each Output before using, sharing, streaming, or posting;
- Attribute the content to your name or to your company;
- Indicate that the content is AI-generated in a way that no user could reasonably misunderstand (for example, by including an introduction that discloses that some or all of the User Content was AI-generated); and
- Not share content that violates these terms.
Notwithstanding any of the foregoing, you take ultimate responsibility for all User Content you post, share, publish, or otherwise distribute.
Disclaimer
AI Product Outputs are generated by ratification intelligence. Infogram disclaims all warranty or guarantee as to the accuracy, completeness, legality, or reliability of the Output and does not accept any liability or responsibility arising in any way from your use of the Output or any omissions or errors contained in the Output. You are responsible for seeking professional advice, as needed, before using or relying on the Output.
AI Partners
Infogram uses third party service providers to provide the AI Products. You acknowledge that any Input you provide, including any personal data you choose to include within that Input, will be shared with the third-party service provider we engage to enable AI functionality within the Services. By using the AI Products, you direct and consent to personal data you include in any Input being transferred to third parties, including OpenAI, LLC in the United States.
